owner of the website, www.salgar.es, is COMERCIAL SALGAR, SL, with tax number
(NIF) A50048826, based at Calle Carretera de Logroño, km 9,500, 50011,
Zaragoza, Spain; entered in the Zaragoza Business Registry under Volume 3652,
folio 13, page Z-47187.
To
ensure use of the website meets transparency, clarity and simplicity criteria, COMERCIAL
SALGAR, SL hereby informs the user that any suggestion, clarification request
or query about this Legal Notice or any other website information document will
be received and resolved by contacting COMERCIAL SALGAR, SL at the email
address, lopd@salgar.net.
PLEASE READ THESE TERMS CAREFULLY
These
General Conditions will expressly regulate the relationship between COMERCIAL
SALGAR, SL, with tax number (NIF) A50048826, based at Calle Carretera de
Logroño, km 9,500, 50011, Zaragoza, Spain (hereinafter, “SALGAR”) and third
parties (hereinafter, “Users”) who register as users and/or purchase products
through the official SALGAR website online store (at http://salgar.net,
hereinafter the “Store”).
2. USER OBLIGATIONS
2.1
The User undertakes to use the Store and its services and acquire the Products
diligently, in accordance with the law, public order and morals and the provisions
of these General Conditions; and to refrain from using them in any way that may
prevent, damage or deteriorate the normal operation and enjoyment of the Store
by Users or which could injure or cause damage to the goods and rights of
SALGAR, its suppliers, Users or in general any third party.
3. PRODUCTS AND PRICES
3.1
SALGAR reserves the right to decide the Products offered to Users through the
Store at all times. In particular, SALGAR may add new Products to those offered
or included in the Store; with it being understood that these new Products will
be governed by the provisions of these General Conditions, unless otherwise specified.
Likewise, SALGAR reserves the right to stop providing access to and use of the
different kinds of Products offered in the Store at any time and without prior
notice.
3.2
The Products actually offered in the Store will be portrayed as reliably as web
display technology allows. The Product features and their prices appear in the
Store, with the latter indicated in Euros without VAT for “professional” users.
Non-professional customers will not be able to purchase the products at these prices
if VAT is included.
4. PRODUCT PAYMENT PROCEDURE AND
METHODS
4.1
SALGAR will send a confirmatory email to a User making a purchase within a
maximum period of 24 (twenty-four) hours. The conditions and payment methods
will always be those the customer has agreed with Salgar on a regular basis, and
can be consulted by contacting SALGAR at any time.
4.2
The order confirmation sent by SALGAR is not valid as an invoice, but only as
proof of purchase. SALGAR will send the invoice by email to the customer's
address once it is produced by the internal Salgar system.
5. RETURNS
5.1
The user has the right to a refund for the purchase if requested within a
period not exceeding 14 (fourteen) business days following receipt of the
Product. An email must be sent to SALGAR at the address, comunicacion@salgar.net,
requesting such a return. Once the User has sent a notification exercising the
right of refund, the Product must be returned together with the duly completed
return sheet, and a copy of the duly completed delivery note or invoice, in
accordance with the instructions given by SALGAR within a maximum period of 14
days; with the direct cost of returning the Product being borne by SALGAR.
5.2
A refund for the amount paid will be by the same payment method used to make
the purchase. The term for this payment will be as established by the Law.
5.3
The right of refund cannot be exercised unless the Product is returned in
perfect condition in its original packaging.
6. CUSTOMER SERVICE
6.1
For any incident, claim or exercise of your rights, the User may send an email
to the address comunicacion@salgar.net.
7. DELIVERY SERVICE
7.1
Sales from the Store are delivered only within the territory of the European
Union and other countries specified by Salgar. Products purchased through the
Store will be sent to the delivery address registered by the User in the Salgar
database after payment has been verified. Delivery time will be as short as
possible and depend upon Product availability.
7.2
The SALGAR delivery service is carried out in collaboration with different
logistics operators of recognized prestige. Orders will not be sent to PO Boxes
or in hotels or other non-permanent addresses.
7.3
The delivery cost is not included in the Product price. The User will be
informed of the exact delivery cost when acquiring the Product.
8. INTELLECTUAL PROPERTY RIGHTS
8.1
When a commercial relationship between the Professional User and SALGAR is
accepted, these conditions govern the use and downloading of the images, CAD
files, certificates, technical sheets and instructions that appear on the website,
www.salgar.net. Access to and/or use of all or part of the contents and/or
services of the portal means full acceptance of these conditions of use.
These
contents are protected by the corresponding copyright in accordance with the
provisions of the Royal Legislative Decree 1/1996, April 12, approving the
consolidated text of the Intellectual Property Law. SALGAR is the owner of
these intellectual property rights and has complete power over the use, transfer,
sale and assignment of them.
8.2
The User acknowledges that all the Store and Product components, the
information and materials contained in them (especially images, texts, logos
and commercial names), the brands, the structure, selection, arrangement and
presentation of the contents and the computer programs used in relation to them
are protected by the intellectual property rights of SALGAR itself or third
parties; and the General Conditions do not attribute any other rights in them other
than those specifically pertaining to such intellectual property rights.
Unless
authorised by SALGAR or, where appropriate, by the third-party holders of the
corresponding rights, or unless it is legally permitted, the User may not
transform, modify, disassemble, reverse engineer, distribute, hire, lend, place
provisions on or allow access to the public through any form of public
communication of any of the components referred to in the previous paragraph.
8.3
Professional Users have the obligation to make legitimate use of the images,
CAD files, certificates, technical data sheets and instructions of the products
provided by SALGAR, and must comply strictly with the current commercial
agreements and conditions. By downloading and using the content provided by
SALGAR, Professional Users undertake NOT to: (i) make inappropriate, fraudulent
or unfair use of the content provided by SALGAR. (ii) infringe intellectual
property rights, copyright protection rights and privacy, among others, (iii)
make use of the content provided by SALGAR if the commercial relationship
between the Professional User and the company is terminated.
SALGAR
may modify the conditions of use of the content provided through the
Professional User Portal at any time.
8.4
Any conflict that may arise from the interpretation and implementation of this
agreement is subject to the jurisdiction of the Courts and Tribunals of the
city of Zaragoza.
9. DATA PROTECTION
9.1
In compliance with Law 15/99 LOPD, we inform you that your personal data and
other information provided through the registration form and from the
transactions made will be included and kept in a file owned by SALGAR for processing,
providing their cancellation is not requested. The processing will be destined for
processing of the sale, customised service of the products and services acquired,
the improvement of this service and promotion of our products and services and those
of third companies linked to SALGAR.
Additionally,
you are informed that your data will be made available to transport companies
(DHL, Schenker, Dachser, TNT) for logistics and transport purposes. As the sole
and exclusive recipient of these data, SALGAR will treat this data with the
utmost confidentiality and not transfer or communicate them to third parties
outside those indicated by current regulations.
The
user expressly authorises the receipt by SALGAR and the aforementioned entities
of commercial communications and promotional offers and contests, including via
electronic means. Yes, I accept.
9.2
Users may exercise their rights of access, rectification, objection or
cancellation at any time by contacting SALGAR, SALGARX or lopd@salgar.net
by email, attaching a copy of their ID card, tax number (NIF) or alternative
means of identification.
9.3
Responses marked with a star (*) on the registration form are mandatory; not-responding
to them will prevent the purchase of the selected products.
10. PASSWORDS
10.1 SALGAR will provide for the use of personal passwords to users who register as such on the website. These passwords will be used to access the services provided via the Website. Users must keep these passwords in the strictest and absolute confidentiality under their own responsibility, while assuming, therefore, any damage or consequences of all kinds derived from the breach or disclosure of this secret. For security reasons, the password for remote access to the services linked to the Website may be modified at any time by the user. Users undertake to notify SALGAR immediately of any unauthorised use of their password, including access by unauthorised third parties.
11. COOKIES
11.1
SALGAR uses cookies to improve its services, facilitate browsing, maintain
security, verify the identity of Users, facilitate access to personal
preferences and follow its use of the Store. Cookies are files installed on the
hard drive of the browser's computer or memory in the folder preconfigured by
the operating system of the User's computer to identify him.
11.2
If Users do not want a cookie to be installed on their hard drive, they must
configure their Internet browsing program not to receive them. Also, Users may freely
destroy cookies. If the User decides to deactivate cookies, the quality and
speed of the service may decrease, with access to some of the services offered
in the Store being lost.
12. APPLICABLE LAW AND JURISDICTION
These
general conditions are governed by Spanish legislation. Any dispute arising
from their interpretation or implementation in relation to the validity,
interpretation, fulfilment or resolution of this contract will be submitted to
the jurisdiction and competence of the Courts and Tribunals of the city of
Zaragoza; waiving any jurisdiction that may apply to the User, provided the
applicable legislation permits.
